01 Agreement to terms

These Terms govern your access to and use of the New Zealand Builders Plate website and related services operated by Maritime Systems Engineers Limited (“MSE”, “we”, “us”, “our”). By accessing or using the website or related services, you agree to these Terms.

02 Platform, provider and customer

Where the platform facilitates Builders Plate enquiries, engagements, records or transactions, the professional-services contract is directly between the customer and the provider identified in the applicable quote, booking or engagement terms.

When MSE provides the professional service, MSE contracts with the customer as principal. When Marsden Marine or another independent provider supplies the service, the platform operator may act as that provider’s disclosed agent for booking, administration, communication and payment collection. The provider remains responsible for its professional work, judgment, insurance and deliverables.

The platform operator does not become the professional provider merely by facilitating a transaction, except where MSE is itself identified as the provider. The applicable quote, booking or engagement terms identify the provider, the operator, each party’s role, the price, applicable taxes and the process for complaints, cancellation and refunds.

03 Website and public records

This website provides information about the scheme and public records associated with participating vessels. A record reflects information declared, supplied or assessed at the time shown. It is not a continuous statement about a vessel’s present condition.

You may use the website and its public records for lawful information and verification purposes. You must not:

  • Attempt to gain unauthorised access to the website or its systems
  • Interfere with the operation or security of the service
  • Upload or transmit malicious code
  • Scrape or systematically reproduce records without permission
  • Misrepresent a vessel record, plate, assessor or affiliation
  • Use the service in breach of any applicable law or regulation

04 Verification and professional advice

A Builders Plate is a concise record of declared vessel characteristics and conformity assessment. It does not replace safe operation, maintenance, a pre-purchase inspection, an insurance survey, statutory certification or professional advice appropriate to your circumstances.

Builders, importers and assessors remain responsible for the information and professional work they provide. Nothing on this website removes any person’s obligations under applicable maritime law, standards or contractual arrangements.

05 Copyright and intellectual property

Unless stated otherwise, website content and the Builders Plate presentation are owned by or licensed to MSE and protected by applicable intellectual-property law. You must not copy, modify, distribute or commercially exploit that content without prior written consent.

You may view, download or share an individual public vessel record for legitimate conformance verification, ownership, sale or insurance purposes, provided it is not altered or presented misleadingly.

06 Disclaimer and liability

The website is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, MSE does not warrant that the website will always be available or that every third-party supplied detail is complete, current or error-free.

To the fullest extent permitted by law, MSE is not liable for indirect or consequential loss arising from use of, inability to use, or reliance on this website. Nothing in these Terms excludes or limits rights or liability that cannot lawfully be excluded, including applicable rights under the Fair Trading Act 1986 and Consumer Guarantees Act 1993.

07 Third-party organisations and links

The website may identify independent builders, distributors, assessors and professional-service organisations, and may link to their websites. Unless expressly stated, those organisations are independent of MSE. MSE is not responsible for their websites, availability, representations or professional services.

08 Privacy

Your use of this website is subject to our Privacy Policy.

09 Governing law

These Terms are governed by the laws of New Zealand. The parties submit to the exclusive jurisdiction of the courts of New Zealand. If any provision is invalid or unenforceable, it will be severed and the remaining provisions will continue.

10 Security cookies

This website may use strictly necessary cookies or similar tokens to serve pages, maintain security and identify malicious traffic. They are not used for advertising or behavioural tracking.
